Great campaign, but did they get a registered trademark (what the ¬Æ symbol is for) by the normal process (which takes many months, at minimum), or did they just grant the symbol to themselves, thinking that’s OK? IANAL, but I understand that if they don’t actually have a registered trademark, using ¬Æ is deceptive, and Give a Damn could in principle get in trouble as a result. They can use “TM” though, as a claim to a mark they intend to register. Their regular site is down right now, so I can’t send this word of warning directly… I just searched the U.S. Patent and Trademark Office Trademark Electronic Search System (TESS), and it appears to confirm my suspicion that Give a Damn does not have a registered trademark.
