A federal judge in Riverside declared the U.S. military’s ban on openly gay service members unconstitutional Thursday, saying the “don’t ask, don’t tell” policy violates the 1st Amendment rights of lesbians and gay men.
U.S. District Court Judge Virginia A. Phillips said the policy banning gays did not preserve military readiness, contrary to what many supporters have argued, saying evidence shows that the policy in fact had a “direct and deleterious effect’’ on the military.
Phillips issued an injunction barring the government from enforcing the policy. However, the U.S. Department of Justice, which defended “don’t ask, don’t tell” during a two-week trial in Riverside, will have an opportunity to appeal that decision.

Now to see if the douchebag in chief uses the lame excuse that he “has to” defend this unconstitutional piece of legislation…
Especially now that Ahhhhhhhhhnold and Mr. Brown have successfully refused to challenge the Prop. 8 ruling. Either Obama’s with us, and he’ll let it pass, or he’s against it, we can’t trust either political party, and I’m packing up and movin’ north to Canada.
Is it any wonder? This has been known for a century. Discrimination has no place in our country. How can we who defend the Constitution; go directly against it. Animus has long been a mainstay in our government policies. It has overstepped its boundaries into our military service. The same as racial segregation. If you are putting your life on the line to defend our laws and liberty, why hide who you are, or lie about it? This policy in and of itself goes against the policy of truth, a requirement of servitude in the armed forces.
