The supreme court won’t take a pro Prop 8 appeal. They’ll review the lower court’s decision, find it to be sound and leave it to stand (which is not a ‘decision’). Proponents are now trying to say Prop 8 bans polygamy? Boies is right to say that’s desperation. The only thing this will do on a federal scale is to set yet another legal precedent (each state’s case has slightly different angle of attack). Prop 8 lost; proponents are beating a dead horse if they appeal (again).
I think federal marriage equality will be passed legislatively (and its constitutionality challenged in court because bigots will think they ‘lost’ when equality is granted). Gay marriage advocates use way too much logic, reason, and precedent for the high court to think lower court rulings need to be heard yet again.
