newmex 300x225 Two More New Mexico Counties Court Ordered To Issue Same Sex Marriage Licenses

Last week Dona Ana County in Mexico began issuing marriage licenses to same sex couples. Then a few days later a judge ordered Santa Fe County to begin issuing them. Now another judge has ordered that both Santa Fe and Bernalillo counties must issue marriage licenses:

Judge Alan Malott ruled Monday afternoon that state law doesn’t prevent same-sex couples from marrying in New Mexico. Malott ruled that the Bernalillo and Santa Fe county clerks must grant marriage licenses to gay couples who apply for them. The court ruling concerns a lawsuit filed on behalf of three lesbian couples who said the state constitution has no explicit ban on marriage rights for same-sex couples.Bernalillo County will start issuing licenses to gay couples at 8 a.m. on Tuesday. The clerk’s computers must be reconfigured.

For those unaware, Bernalillo County is the largest in New Mexico, containing Albuquerque. The combined population of the three counties now issuing marriage licenses is approximately half that of the entire state.
